This Privacy Policy describes the privacy practices of Brand Specific Marketplace, Inc.
1. BRAND SPECIFIC MARKETPLACE PLATFORM
Brand Specific Marketplace is a digital, AI-driven, dealer-to-dealer, B2B platform helping dealers capture new and used car sales market share, as well as retrieve powerful market data and insights. We have pioneered a subscription-based, closed online live auction service that funnels brand specific inventory back to the brand’s dealerships at a significantly lower price, and helps recapture vehicles sold outside of their network.
Because we are exclusively a B2B platform, we treat all personal information we collect in connection with Brand Specific Marketplace as pertaining to individuals acting as business representatives, and not in their individual or household capacity.
2. PERSONAL INFORMATION COLLECTION
We collect the following categories of personal information:
Information you provide to us:
- Contact, account, and profile information, such as your first and last name, business email and mailing addresses, phone number, profile photo, company/dealership name, and professional title.
- Feedback or correspondence, such as information you provide when you contact us with questions, feedback, or otherwise correspond with us online.
- Payment information needed to complete your transactions with us, including name, payment card information, and billing information. This information may be processed by our payment service provider, which may handle your payment information in accordance with its own privacy policy.
- Usage information, such as information about how you use our platform and interact with us, including information associated with any content you upload to the platform or otherwise submit, and information you provide when you use any interactive features of the platform.
- Marketing information, such as your preferences for receiving communications about our platform, and details about how you engage with our communications.
- Other information that we may collect, which is not specifically listed here, but which we will use in accordance with this Privacy Policy or as otherwise disclosed at the time of collection.
Information we obtain from third parties:
- Social media. We may maintain pages on social media platforms, such as X, Instagram, Facebook, and other third-party platforms. When you visit or interact with our pages on those platforms, the platform provider's privacy policy will apply to your interactions and their collection, use, and processing of your personal information. You or the platforms may provide us with information through the platform, and we will treat such information in accordance with this Privacy Policy.
- Other sources. We may obtain your personal information from other third parties, such as publicly available sources and data providers.
Data collected automatically. We, our advertising partners, and our service providers may automatically log information about you, your computer or mobile device, and your interaction over time with our platform, our communications, and other online services, such as:
- Device data, such as your computer’s or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, language settings, mobile device carrier, radio/network information (e.g., WiFi, LTE, 3G), and general location information such as city, state, or geographic area.
- Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the website, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access, and whether you have opened our marketing emails or clicked links within them.
We use the following tools for automatic data collection:
- Cookies, which are text files that websites store on a visitor’s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, and helping us understand user activity and patterns.

- Market our platform, and other products and services that we believe may be of interest to you, including third-party offerings.
- Engage advertising partners, including third-party advertising companies and social media companies, to display ads on our website and other online services. These companies may use cookies and similar technologies to collect information about your interactions with our website, our communications, and other online services, and use that information to serve online ads that they think will interest you. This is called interest-based advertising. We may also share information about our users with these companies to facilitate interest-based advertising to our or similar users (known as a “lookalike audience”) on other online platforms. - Affiliates. Other entities within our family of companies for the purposes described in this Privacy Policy.
- Other users of the platform. We make certain contact and profile information available to other users of the platform to facilitate communications and transactions on BrandSpecificMarketplace.com, and for other purposes described in this Privacy Policy. Our platform also allows users to view which dealer ultimately won the auction in which the user participated.
- Service providers. Companies and individuals that provide services on our behalf or help us operate our platform or our business (such as logistics and transportation providers, hosting, information technology, customer support, email delivery, and website analytics services).
- Professional advisors. Professional advisors, such as lawyers, auditors, bankers, and insurers, where necessary in the course of the professional services that they render to us.
- Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for thecompliance and protection purposesdescribed above.
- Business transferees. Acquirers and other relevant participants in business transactions (or negotiations for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale, or other disposition of all or any portion of the business or assets of, or equity interests in, Brand Specific Marketplace, Inc. (including in connection with a bankruptcy or similar proceedings).
- Marketing and business partners. Our affiliates and third-party companies with which we may cooperate to offer you products and services that we believe may be of interest to you. We do not share your transaction history with third parties for those parties’ own purposes.
- Advertising partners. Third-party advertising companies, including for theinterest-based advertisingpurposes described above, which may collect information on the website through cookies and other automated technologies.
5. YOUR RIGHTS & CHOICES
Opt out of marketing communications. You may opt out of marketing-related communications by following the opt-out or unsubscribe instructions contained in the marketing communications we send to you.

We keep personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, while we have a business need to do so, or as required by law (e.g. for tax, legal, accounting, or other purposes), whichever is longer.

We employ a number of technical, organizational, and physical safeguards designed to protect the personal information we collect. However, no security measures are fail-safe, and we cannot guarantee the security of your personal information.
